服务条款

1. 条款接受

访问或使用 Chatloom（以下简称「服务」）即表示您同意受本服务条款（以下简称「条款」）的约束。如果您不同意本条款，则不得使用本服务。

These Terms constitute a legal agreement between you and WORKSJO LTD ("Company," "we," "us," or "our"), a company registered in England and Wales. "Chatloom" is a trading name and brand of WORKSJO LTD.

2. 服务描述

Chatloom 是一个 AI 聊天机器人平台，帮助企业创建、部署和管理智能聊天机器人。我们的服务包括：

• AI 聊天机器人的创建和自定义
• 网站小部件嵌入
• 对话管理和数据分析
• 训练数据管理
• API 访问（适用于相应套餐）

3. 账户注册

使用本服务，您必须：

• 提供准确、最新且完整的信息
• 维护和更新您的账户信息
• 保证账户凭证的安全
• 年满 18 周岁
• 不冒充任何个人或实体

您对您账户下发生的所有活动负责。

4. 订阅套餐和定价

4.1 套餐

我们提供以下订阅套餐：

• 免费版：1 个智能体，100 条消息/月
• 基础版：1 个智能体，5,000 条消息/月，$29/月或 $279/年
• 专业版：3 个智能体，15,000 条消息/月，$79/月或 $758/年

4.2 计费

• 订阅费用根据您选择的套餐按月或按年预付
• 付款通过 Stripe 安全处理
• 价格可能在提前 30 天通知后调整
• 除法律要求外，所有费用均不退款

4.3 使用限制

每个套餐每月有特定的消息限额。当您达到限额时，聊天机器人将暂停运行，直到下一个计费周期或您升级套餐。我们会在使用量达到 80% 和 100% 时通知您。

5. 可接受使用

您同意不将本服务用于：

• 违反任何法律或法规
• 侵犯知识产权
• 传输有害、攻击性或非法内容
• 骚扰、虐待或伤害他人
• 分发垃圾信息或恶意软件
• 试图未经授权访问系统
• 干扰服务的正常运行
• 逆向工程或复制我们的技术

6. AI 和内容

6.1 AI 生成的内容

Chatloom 使用人工智能生成聊天机器人回复。您理解并同意：

• AI 的回复可能并不总是准确或恰当的
• 您有责任监控聊天机器人的交互
• 我们不保证 AI 生成内容的质量
• AI 模型可能会随时间改进

6.2 您的内容

您保留您提供的所有内容的所有权。使用本服务即表示您授予我们：

• 使用您的内容提供服务的许可
• 处理和分析数据以改进服务的权利
• 按您配置的方式展示聊天机器人的许可

7. 知识产权

本服务，包括所有软件、设计、文本、图形和其他内容（用户内容除外），均为 WORKSJO LTD 所有，受版权、商标和其他知识产权法保护。

「Chatloom」及我们的标志是 WORKSJO LTD 的商标。未经事先书面同意，您不得使用我们的商标。

8. 服务可用性

We work to keep the Service reliable, but unless we have signed a separate written service-level agreement with you, we do not guarantee:

• Uninterrupted or error-free operation
• Any specific uptime percentage outside an agreed Enterprise SLA
• Compatibility with all systems
• Prevention of all security threats

We reserve the right to modify, suspend, or discontinue the Service at any time, with reasonable notice where practical. Enterprise customers with a signed SLA are governed by the terms of that SLA.

9. 取消与终止

9.1 由您取消

您可以随时通过账户设置取消订阅。取消将在当前计费周期结束时生效。

9.2 由我们终止

如果您有以下行为，我们可能会暂停或终止您的账户：

• 违反本条款
• 参与欺诈活动
• 未支付订阅费用
• 构成安全风险

10. 免责声明

本服务按「现状」和「可用」的基础提供，不附带任何明示或暗示的保证。

我们不承担所有保证责任，包括但不限于适销性、特定用途适用性和非侵权保证。

11. 责任限制

Subject to the carve-outs below, and to the maximum extent permitted by applicable law, WORKSJO LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Service.

Our total aggregate liability under or in connection with these Terms shall not exceed the amount you paid us in the 12 months preceding the event giving rise to the claim. Nothing in these Terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) any other liability that cannot be excluded or limited under applicable law (including, where you are a UK consumer, your statutory rights under the Consumer Rights Act 2015).

12. 赔偿

您同意对因您使用本服务或违反本条款而产生的任何索赔、损害或费用，向 WORKSJO LTD 提供赔偿并使其免受损害。

13. 适用法律

本条款受英格兰和威尔士法律管辖。任何争议应受伦敦（英国）法院的专属管辖。

我们可能随时修改本条款。重大变更将通过电子邮件或服务通知。变更后继续使用即表示接受。
